OK but like why is this so complicated?? You get money, you pay taxes on it, then they want it back and you have to jump through tax hoops to maybe get some relief. The whole unemployment system is backwards.
honestly just apply. i thought i wouldnt qualify either but i did and got like $280 a week for 6 months. saved my butt while job hunting. the application asks all the right questions and theyll tell you if you qualify or not. no harm in trying
honestly the whole unemployment system is designed to discourage people from applying. they make the qualifications confusing on purpose so fewer people will file claims. but if you lost hours through no fault of your own you should apply regardless
Quick question - do you still qualify if you quit your job? My manager has been making my life miserable and I'm thinking about leaving but don't want to lose out on benefits.
Generally no, quitting disqualifies you unless you can prove you had 'good cause' like unsafe working conditions or harassment. The burden of proof is on you to show the situation was so bad that a reasonable person would have quit. It's much harder to get approved compared to being laid off or having hours reduced.
Just want to add that you should inform your bankruptcy attorney about your unemployment claim right away. They'll need to include it in your means test calculation and list it as income on Schedule I. Also make sure you understand that while your current unemployment is protected, any future wages from employment you get after filing might be subject to different rules depending on whether you file Chapter 7 or Chapter 13.

I've been trying to get through to NYS Department of Labor for weeks to ask about my benefit calculation because something seems wrong with my amount. The phone lines are always busy and I can't get a real person to explain how they came up with my weekly benefit. It's so frustrating when you need answers about your claim!

just to add some context - during covid there were multiple programs. regular UI got the $600 boost, plus there was PUA for gig workers and PEUC for extended benefits. some people were getting unemployment for like 18+ months which never happens normally. now its back to the standard 26 weeks maximum and just your regular benefit amount
