Wait I'm confused - if you're applying for disability doesn't that mean you CAN'T work? How can you also say you're able and available for work for unemployment? This seems like fraud to me.
It's not fraud if you're honest about your limitations. Disability and unemployment have different definitions of 'unable to work.' You can be disabled from your previous job but still able to do other types of work. The key is transparency with both agencies.

The NYS Department of Labor unemployment system is such a NIGHTMARE!! Even if you qualify they make you jump through so many hoops. You have to file weekly claims, do job searches, report any income. And don't get me started on how long adjudication takes when employers fight your claim!

•I understand the frustration, but the job search requirement and weekly claims are federal requirements, not just NYS Department of Labor rules. Most legitimate claims do get approved eventually, even if there's an initial contest from the employer.
