Worth not wasting your time calling for hours.

Was a bit nervous or untrusting at first, but my calls went thru. First time the wait was a bit long but their customer chat line on their page was helpful and put me at ease that I would receive my call. Today my call dropped because of EDD and Claimyr heard my concern on the same chat and another call was made within the hour.

The NYS Department of Labor unemployment system is such a NIGHTMARE!! Even if you qualify they make you jump through so many hoops. You have to file weekly claims, do job searches, report any income. And don't get me started on how long adjudication takes when employers fight your claim!

I understand the frustration, but the job search requirement and weekly claims are federal requirements, not just NYS Department of Labor rules. Most legitimate claims do get approved eventually, even if there's an initial contest from the employer.

Tell her to be prepared for the job search requirements too. Even with partial unemployment, she'll need to be actively looking for work and keep a log of her job search activities. NYS Department of Labor requires a certain number of work search contacts each week.

Good point! Do you know how many job contacts she needs to do per week? And does applying online count the same as going to businesses in person?

Wait, can you even get unemployment if you're pregnant? I thought that automatically disqualified you since you're not available for full-time work.

You should also look into whether your employer offers short-term disability benefits. Sometimes that's a better option than unemployment for pregnancy-related leave, especially if you plan to return to work after the baby is born. UI benefits might complicate your return to work timeline.

They don't offer STD unfortunately. And I'm not sure if I'll be able to return to the same position after the baby anyway since they're already talking about restructuring my department.

Just be patient with the process. The NYS Department of Labor is dealing with a lot of claims right now. As long as you filed everything correctly and keep filing your weekly claims, you should be fine.

Wait I'm confused - if you're applying for disability doesn't that mean you CAN'T work? How can you also say you're able and available for work for unemployment? This seems like fraud to me.

It's not fraud if you're honest about your limitations. Disability and unemployment have different definitions of 'unable to work.' You can be disabled from your previous job but still able to do other types of work. The key is transparency with both agencies.

OP definitely look into this more before filing. I know someone who got in trouble for collecting both even though they thought they were doing everything right. The rules are super confusing and NYS Department of Labor doesn't always explain things clearly.
