I've been waiting 3 weeks and still nothing!! Called the phone number like 50 times and can never get through to a real person. The whole system is broken if you ask me. WAIT this is happening to so many people right now!! The NYS Department of Labor is going back through ALL the pandemic claims and finding reasons to demand money back. It's like they're trying to recoup their losses or something. My friend works at H&R Block and she says they're seeing tons of these overpayment notices this year. The system is totally broken!
Don't panic yet! Many of these overpayment determinations get overturned on appeal. The key is to respond quickly and provide thorough documentation. Make sure you understand exactly what they're claiming - was it an issue with your separation reason, earnings reporting, or availability for work? Each type of issue requires different evidence to dispute.
The notice just says 'eligibility determination' but doesn't specify. How do I find out the exact reason so I know what documentation to gather?

Just make sure you file as soon as possible after losing your job! There's usually a waiting period anyway but you don't want to delay getting the process started. The NYS Department of Labor system can be slow and if there are any issues with your claim it takes forever to sort out. Also start looking for work immediately because you'll need to do job searches every week.

ugh the whole unemployment system is such a nightmare. took me 6 weeks to get my first payment because they said i had some issue that needed adjudication and nobody could explain what that even meant. good luck dealing with NYS Department of Labor bureaucracy
