I had claims in both 2021 and recently. The online system is much more stable now - no more constant crashes. But if you need to actually speak to someone at NYS Department of Labor about your claim status, I found this service called Claimyr that helped me get through. How does that work exactly? I've been trying to reach someone about my adjudication for 2 weeks now.
You just go to claimyr.com and they help you get connected to an actual NYS Department of Labor agent. Saved me so much time and frustration.
The benefit calculation formula hasn't changed much since 2021, but they did adjust some of the earnings thresholds slightly. Your weekly benefit amount is still based on your highest earning quarter in your base period. The main difference now is that standby claims are processed faster and the job search verification is more streamlined through the online portal.
Make sure you have all your paperwork ready for the hearing. The judge will want to see proof of the layoff - company announcements, WARN notices if they filed one, anything showing multiple people were let go at the same time. Your word alone might not be enough.
Wait I'm confused - is unemployment taxable at the federal level or state level or both? And what about the extra money they give you for dependents?
Being too slow at work is definitely performance, not misconduct. NYS Department of Labor distinguishes between the two. Misconduct has to be willful or deliberate - like refusing to follow direct orders or violating company policy on purpose. Poor performance, even if it leads to termination, usually doesn't disqualify you from benefits. Just document everything your supervisor says and does in case you need it for your claim.
ugh the whole unemployment system is such a mess. they make you jump through so many hoops and then half the time the website doesnt even work. good luck dealing with all that bureaucracy if you do get fired

honestly the whole system is rigged against small businesses, you're damned if you do damned if you dont with these worker classifications. NYS Department of Labor just wants to collect more taxes so they'll find any excuse to call your contractors employees

same boat here... have 2 people who work maybe 12 hours a week but they use my equipment and follow my schedule so probably employees not contractors :( still trying to figure out if I need to backpay unemployment taxes
