EXCESSIVE EARNINGS is such a scary term for something that just means 'we'll reduce your payment.' The NYS Department of Labor loves to make everything sound like you're committing fraud when you're just trying to survive and work part-time.
THE ROBOTS ARE TAKING OVER AND NYS DEPARTMENT OF LABOR DOESN'T CARE! They just want you to file your weekly claims and pretend everything is fine while entire industries disappear. This structural unemployment is going to get worse and worse.
My brother went through something similar when his warehouse got all those automated picking systems. He had to do some computer classes but ended up getting a better job operating the new equipment. Don't give up - sometimes these changes work out better in the long run. Just make sure you keep filing those weekly claims while you figure out your next step.
ugh the whole system is so frustrating!! I got fired for attendance too but mine was because of childcare issues when my babysitter kept canceling last minute. Still waiting to hear back from NYS Department of Labor after filing 2 weeks ago. Why does everything with unemployment take FOREVER??
Also be prepared for the possibility of adjudication if there's anything unusual about your termination. If your employer contests your claim or if there are questions about why you left, your claim goes into adjudication status where they investigate further. This can add weeks to the process unfortunately.
What would cause my employer to contest it? I was laid off due to store closure, so that should be straightforward, right?

omg this is so accurate!!! my worker acted like she was doing me some huge favor just by looking at my file. meanwhile my rent is due and I haven't gotten paid in 6 weeks because of their stupid adjudication process

I think you're being a bit dramatic with the Lex Luthor comparison. These workers deal with hundreds of cases and have to follow federal and state regulations. The adjudication process exists to prevent fraud, which costs taxpayers millions. Maybe try approaching them with more patience and understanding of their constraints rather than assuming malicious intent.
