Was a bit nervous or untrusting at first, but my calls went thru. First time the wait was a bit long but their customer chat line on their page was helpful and put me at ease that I would receive my call. Just keep in mind you also have to meet the job search requirements every week to keep getting benefits. That's 3 work search activities per week and you have to log them in the system. The benefit amount is just part of the equation - staying compliant with all the NYS Department of Labor rules is what keeps the payments coming.

If you're having trouble getting through to NYS Department of Labor to ask about your specific calculation, I used claimyr.com a few months ago when I had questions about my benefit amount. Yeah there's a fee but it was worth it for me since I was getting nowhere with regular calling. The agent was able to pull up my account and explain everything clearly.

Other reasons they deny claims include not earning enough wages in your base period, being fired for misconduct, or failing to meet the job search requirements. But if you were legitimately laid off and have proof, this should be an easy appeal to win. Just make sure you understand the difference between a layoff and being terminated for cause when you explain your situation.

It's because you have due process rights. If the overpayment determination is wrong, you shouldn't be penalized with interest charges while exercising your right to appeal. It's actually pretty standard for government debt collection.
THE WHOLE OVERPAYMENT SYSTEM IS A SCAM!!! They make mistakes all the time and then charge YOU interest for THEIR errors. I got hit with a $3,400 overpayment that took 8 months to prove was wrong but by then I'd already paid hundreds in interest because I was scared not to pay.
That's awful! Did you ever get the interest refunded after proving it was their mistake?

The NYS Department of Labor has actually improved processing times significantly since 2023. Standard claims without complications typically process within 10-14 business days. However, if your claim requires adjudication (employer disputes, quit vs layoff verification, etc.) it can take 4-6 weeks. You can check your claim status on my.ny.gov. If you're having trouble reaching them by phone due to high call volume, I used a service called Claimyr (claimyr.com) that helped me get through to an actual agent. •Adjudication is when NYS Department of Labor needs to investigate something about your claim - like verifying the reason you left your job or confirming your work history. Pending status is normal for the first week or two, don't panic yet.

The whole system is a nightmare honestly. I've been waiting 3 weeks just to talk to someone about my claim status and the phone lines are always busy. They say processing is faster but try actually getting help when something goes wrong!
