Was a bit nervous or untrusting at first, but my calls went thru. Who decides if you get unemployment benefits through NYS Department of Labor?

I'm really confused about the whole unemployment approval process. I filed my claim last week and it's showing pending status. Who actually makes the decision about whether I qualify for benefits? Is it just some computer algorithm or do real people at NYS Department of Labor review my case? I'm worried because my last job ended kind of weird - I was basically forced to quit because they cut my hours to like 5 per week. Will someone understand that situation or will the system just see 'quit' and deny me automatically?

THE WHOLE SYSTEM IS A MESS!!! They make you jump through hoops and then some random person decides your fate. I got denied even though my employer laid me off and it took MONTHS to get it overturned. The appeals process is ridiculous too.

Can you collect unemployment on social security in NYS?

I'm 67 and have been collecting social security for about 2 years now. I was working part-time at a retail store to supplement my income but they laid me off last month due to budget cuts. A friend told me I might be able to get unemployment benefits even though I'm on social security but I'm not sure if that's true. Has anyone been in this situation with NYS Department of Labor? Do they reduce your unemployment if you're getting social security payments?

OMG I've been trying to call NYS Department of Labor for WEEKS about this exact question and can never get through! The phone lines are always busy or I get disconnected after waiting forever. It's so frustrating when you just need a simple answer about whether you can collect both benefits.

Just make sure when you file your weekly claim you report your social security as 'other income' if they ask. I think there's a section for that but I'm not 100% sure how it affects the calculation.

Actually, you don't report social security retirement benefits as income on your weekly claim certification. NYS Department of Labor specifically excludes social security retirement benefits from countable income. You only report wages from work, not social security payments.

NYS Department of Labor areas with highest unemployment rates - what regions are affected most?

I've been trying to understand which parts of New York State have the highest unemployment rates right now. My cousin lost her job in Buffalo last month and she's saying it's really bad up there, but I'm in Queens and it seems like there are jobs everywhere here. Does the NYS Department of Labor publish data on which counties or regions have the worst unemployment? I'm thinking about relocating for work but want to avoid areas where finding a job might be harder. Also wondering if certain areas get different treatment for UI benefits or if the job search requirements are the same statewide?

From what I've seen the rural counties definitely struggle more. Agriculture and manufacturing jobs disappeared and there's not much to replace them. NYC area has more diversity in industries so even when one sector is down others might be hiring. But cost of living is so different too - $500/week UI goes a lot further upstate than in Manhattan

Do I have to file something every week? I thought once you got approved you just automatically get paid. weekly claims are basically just nysdol making sure your still unemployed lol its not that complicated just answer the questions honestly

How does NYS Department of Labor calculate my weekly unemployment benefit amount?

I just got approved for unemployment after losing my restaurant job and I'm confused about how they figured out my weekly benefit amount. My benefit rate shows $365 per week but I have no idea how they came up with that number. I made different amounts each week because of tips and my hours varied a lot. Does anyone know how NYS Department of Labor actually calculates this? I want to make sure they got it right because this seems higher than I expected.

The maximum weekly benefit rate in NY is $504 right now so $365 sounds reasonable depending on your earnings history. Just remember you have to report any work you do each week when you file your weekly claim or they'll hit you with an overpayment later.

Been there! The calculation threw me off too when I first filed. One thing to watch out for is if you had multiple jobs during your base period - sometimes employers don't report wages correctly or on time and it can affect your benefit calculation.
