The whole system is such a mess tbh. I filed in October and it took them 6 WEEKS to process my claim because of some stupid adjudication issue they never explained properly. Good luck dealing with their website crashes and busy phone lines!
The whole unemployment classification system is just academic nonsense anyway! Whether you call it cyclical or structural or whatever, we're all just trying to pay our bills while looking for work. NYS Department of Labor should focus on getting people their money faster instead of making us jump through hoops with job search requirements and weekly certifications.

The harassment angle is probably her strongest case if she can prove it. Document EVERYTHING - dates, what was said, who was there, any emails or texts. NYS Department of Labor takes workplace harassment seriously as good cause for quitting. Just make sure she follows the proper procedures at work first - file complaints, request transfers if possible, give the employer a chance to fix it.

I'm dealing with something similar - my company is offering early retirement to avoid layoffs. HR said we could potentially still qualify for unemployment if we don't actually retire but just leave the company. Maybe look into that option instead? Though I'm not sure how NYS Department of Labor would view it.

Most important thing is just be honest about everything and keep good records. The NYS Department of Labor will audit claims randomly so you want to have documentation ready if they ask for it.
