How to file for unemployment after being fired - NYS Department of Labor process?

Got terminated from my retail job yesterday and I'm completely lost on what to do next. My manager said it was due to performance issues but I think it was really because I called out sick twice last month. Either way, I need to figure out how to file for unemployment benefits through NYS Department of Labor. I've never done this before and don't even know where to start. Do I need to wait a certain amount of time before applying? What documents do I need? Will being fired disqualify me automatically? Really stressed about paying rent next month.

The NYS Department of Labor system is such a nightmare honestly. They make it so hard to get benefits even when you deserve them. I got fired from my last job for 'attendance issues' which was total BS and had to fight for months to get my benefits. Good luck dealing with their bureaucracy.

How is weekly unemployment benefit calculated by NYS Department of Labor?

I'm trying to figure out exactly how the NYS Department of Labor calculates my weekly benefit amount. I made about $52,000 last year working at a marketing firm, but my weekly benefit is only $347. That seems low compared to what I was making. Does anyone know the actual formula they use? I looked on the my.ny.gov site but it's pretty confusing with all the base period stuff.

The whole system is ridiculous. I made $65K last year and only get $387 a week. Meanwhile my rent alone is $1,800 a month. How are we supposed to survive on these amounts while looking for work?

For anyone still confused about the calculation: NYS Department of Labor looks at your four highest quarters of earnings in your base period, adds them up to see if you qualify, then uses ONLY your single highest quarter to calculate the weekly amount. So if your highest quarter was $13,000, you'd get roughly $250 per week (13,000 ÷ 26 ÷ 2). The exact formula has some variations but that's the basic idea.

Do employers pay unemployment insurance premiums to NYS Department of Labor?

I'm trying to understand how the unemployment system works in New York. When I file for benefits through NYS Department of Labor, where does that money actually come from? Do my previous employers have to pay some kind of unemployment insurance to cover these payments? My friend said something about employers paying into a fund but I'm not sure if that's accurate. Just curious about how this all works behind the scenes.

The whole system is basically employers subsidizing their former workers. Which is fine in theory but the rates and regulations keep getting more complicated every year. Some small businesses struggle with the administrative burden of tracking all the NYS Department of Labor requirements.

NYS Department of Labor claim during recession - do benefits get extended when unemployment is high?

I've been on unemployment for about 16 weeks now and my regular benefits are running out soon. I keep hearing that when unemployment is high like it is now, they sometimes extend benefits or make changes to the program. Does anyone know if NYS Department of Labor has any plans to extend UI benefits during this recession? I'm worried about what happens when my 26 weeks runs out since jobs are still really hard to find in my area.

This whole situation is so frustrating!! The economy is clearly in bad shape but they're not doing anything to help people who can't find work. I've applied to over 200 jobs and gotten maybe 5 interviews. How are we supposed to survive on just 26 weeks when there are NO JOBS out there?

I feel you, it's really tough out there right now. Are you making sure to log all your job search activities? NYS Department of Labor requires documentation of your search efforts.

Keep in mind that even during recessions, you still need to meet all the regular requirements - filing weekly claims, documenting job searches, being available for work. The economic conditions don't change those basic UI rules. Make sure you're staying compliant while waiting to see if any extensions become available.

Just wanted to say good luck with everything. Being unemployed is stressful enough without having to navigate all the paperwork and requirements. At least the weekly claims are pretty quick once you get the hang of it.
