The NYS Department of Labor definition also includes monetary eligibility requirements. You need to have earned a certain amount in wages during your base period, which is usually the first four of the last five completed calendar quarters before you file your claim. If you don't meet the wage requirements, you won't qualify even if you meet all the other criteria.
I had trouble getting through to NYS Department of Labor by phone when I needed to check on my benefit amount calculation. Kept getting busy signals and when I did get through, I'd get disconnected. Someone on here mentioned claimyr.com which helped me actually reach an agent to verify my weekly benefit rate. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Made it so much easier to get my questions answered about the payment calculation.
I had trouble getting through to NYS Department of Labor by phone when I had questions about my online application, but I found this service called Claimyr (claimyr.com) that actually got me connected to a real person. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me hours of busy signals and hang-ups when I needed help with my claim status.
THIS SYSTEM IS SO BACKWARDS!!! Why should someone who worked their whole life have to jump through hoops like this? The whole thing is designed to deny benefits to people who actually need them. Retirement should be a choice not forced by corporate greed!!!
Wait I'm confused - if you retire don't you get social security? Can you get both unemployment and social security at the same time? That doesn't sound right to me.
You can collect both Social Security and unemployment simultaneously in New York. Social Security doesn't count as disqualifying income for UI purposes. However, you still need to meet the able and available for work requirements.

If you're having trouble getting through to the NYS Department of Labor by phone to check on your claim status or get help with the application, I had good luck using a service called Claimyr (claimyr.com). They helped me get connected to an actual agent when I was stuck in adjudication. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me hours of calling and getting busy signals.

•Is that one of those services that charges you? Seems sketchy to pay someone to make a phone call for you

•I was skeptical too, but honestly after spending 2 days trying to get through myself and getting nowhere, it was worth it. They don't ask for your personal info or anything weird - they just help you get connected to the right department.

•The system definitely has its frustrations, but most people do get approved if they're eligible. The key is being thorough with your initial application and staying on top of your weekly claims.
