My brother went through this exact thing last year and his employer tried to claim he was fired for attendance issues even though he was clearly laid off with 15 other people when they closed the department. Just remember the money is taxable! I made the mistake of not having taxes withheld from my unemployment benefits and owed a bunch at tax time. You can request federal and state taxes be taken out when you file your weekly claims.

Just to be clear - you file your unemployment income on your regular tax return using the 1099-G form. You don't send money directly to NYS Department of Labor for taxes. The only time you'd send money directly to NYS Department of Labor is if you had an overpayment that you needed to repay.
