UGH the whole system is such a nightmare though! I've been trying to get through to someone at NYS Department of Labor for weeks about my claim status and the phone just rings forever or I get disconnected. How are you supposed to get answers when you can't even talk to a human being?
I had the exact same problem until someone told me about this service called Claimyr (claimyr.com). They actually get you connected to a real NYS Department of Labor agent on the phone. Seriously saved my sanity dealing with this whole unemployment mess.
btw make sure you start looking for work right away because they require you to do job searches every week. i think its like 3 work search activities per week now
The unemployment rate was definitely high but I think it's important to remember that NYS Department of Labor was also dealing with unprecedented claim volumes. My brother works there and said they were completely overwhelmed. The systems weren't designed for that many people filing at once.
just started collecting myself after getting cut from my restaurant job. the benefits aren't amazing but they help cover basics while job hunting. make sure you certify every week on time or you'll lose that week's payment
yeah you should be fine for benefits. i got fired for failing a drug test years ago and still got unemployment (different situation but point is they dont just deny everyone who gets fired). background check stuff is usually not considered work misconduct unless you lied about it which it sounds like you didn't
One more thing - when you file, be prepared for the employer to contest your claim. They might argue it was misconduct even though it wasn't work-related. If that happens, you'll get a chance to explain your side during the adjudication process. Keep any documentation showing you disclosed the background information during hiring.

The whole NYS Department of Labor system is broken!! They approve claims but then don't pay for weeks without explanation. It's like they want people to give up and stop claiming.
