I'm a former Washington ESD adjudicator and cases like yours were pretty common. We'd look at the employee handbook, any progressive discipline, witness statements, and the employee's work history. A single incident of questioning management without profanity or threats usually doesn't meet the misconduct standard.
Final update if anyone's still following: My claim was approved without even going to adjudication! Got my first payment this week. Thanks everyone for the encouragement to apply even though I was fired.
This is helpful info. I was dreading dealing with the unemployment taxes but it sounds more straightforward than I thought.
Update on my earlier comment - I tried that Claimyr service someone mentioned and actually got through to Washington ESD about my login issues. Was able to download my 1099-G finally. Pretty impressed that it actually worked.
Just wanted to mention that if you need to contact Washington ESD for any reason during this process, claimyr.com has been a lifesaver for actually reaching someone. The phone system is still pretty overwhelmed and this helps you get through to an actual person when you need answers.
The economic uncertainty is real but try not to let it paralyze you. People are still getting hired every day, even in tough times. Your husband's experience and skills don't disappear just because the job market is challenging. Stay positive and keep moving forward.
I used Claimyr last week when I had issues with my claim being stuck in adjudication for three weeks. Finally got through to someone who could actually help me understand what was going on. Way better than the runaround I was getting trying to call normally.
The bottom line is file as soon as you can after your layoff. Washington ESD won't penalize you for filing quickly but they also won't backdate benefits if you file late.

This thread has been super helpful! I've been scared to take on any freelance work but sounds like it's actually encouraged as long as you report everything properly.

•Same here! Glad I asked. Seems like a good way to supplement while looking for full-time work.

•Exactly. Better than just sitting around waiting for the perfect job to appear.

For anyone who does run into issues or has specific questions about their situation, I really can't recommend Claimyr enough. Having a real person at ESD answer your questions instead of trying to interpret the website or wait weeks for an online message response is invaluable.

•You're welcome! Just knowing you have that option takes a lot of stress out of dealing with unemployment stuff.
