I had a similar situation where I couldn't reach anyone at NYS Department of Labor to explain my side when my employer contested my claim. The phone lines are always busy and I kept getting hung up on. I ended up using a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. It was really helpful for explaining my situation properly instead of just waiting weeks for them to decide without hearing from me.
I had trouble reaching NYS Department of Labor to ask similar questions about employer obligations. Ended up using this service called Claimyr (claimyr.com) that helped me get through to an actual agent who explained the whole funding system. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped clear up my confusion about who pays what.
Before considering legal action, make sure you're keeping detailed records of every interaction with NYS Department of Labor. Save all emails, take screenshots of your online account, write down dates and times of phone calls and what was discussed. If they're truly violating due process or their own regulations systematically, this documentation will be crucial. Also check if your state has an unemployment insurance ombudsman or inspector general who handles complaints about the department's operations.
This whole system is ridiculous! Why do they need some random account number that employers hide from us? I worked there for 3 years and never once saw this mysterious number anywhere. Just another way to make filing claims impossible.

If you're having trouble getting through to NYS Department of Labor to check on your claim status, I found this service called Claimyr that actually got me connected to an agent when I couldn't get through on my own. They have a website at claimyr.com and there's a demo video at https://youtu.be/qyftW-mnTNI showing how it works. Saved me hours of calling and getting hung up on.

•How much does something like that cost? Seems like they'd charge a lot for something the state should provide for free

•It's worth checking out their site for pricing, but honestly when you're dealing with delayed benefits it pays for itself quickly. I was stuck in adjudication for weeks.

The whole system is so backwards! Why should there be a waiting week when people need money immediately after losing their job? And don't get me started on how they side with employers on attendance issues even when people have legitimate reasons for missing work.

•totally agree, the waiting week thing makes no sense when bills don't wait
