Had trouble getting through to NYS Department of Labor when I needed to clarify something similar. If you run into issues reaching them by phone, I used a service called Claimyr (claimyr.com) that helped me get through to an actual agent. ugh this is so stressful! I'm in week 4 of waiting and keep checking my account every day hoping something changed. What if they deny it after all this waiting?? I documented everything when I got laid off but still worried something went wrong.
The 2024 delays have been worse than usual from what I've seen. Budget cuts at NYS Department of Labor mean fewer staff to process claims. Your best bet is to keep trying the phone lines early morning around 8am when they open, or try that claimyr thing someone mentioned if you're really stuck.
THE WHOLE SYSTEM IS RIGGED AGAINST WORKERS!! They'll find any excuse to deny your claim and side with the employer. I got fired for ONE mistake after 5 years of perfect attendance and they still denied me. Had to go through the whole appeal process just to get what I deserved.
Make sure you keep records of everything - your termination letter, any documentation about the attendance issues, witness statements if you have them. The more evidence you can provide during adjudication, the better your chances. Also start your job search immediately because you'll need to show you're actively looking for work.
Make sure your bankruptcy attorney understands unemployment benefits! Some lawyers don't deal with this situation often. The UI payments should be listed on Schedule I (current income) and you may need to update your filing if your benefits end before the case closes.

THE WHOLE SYSTEM IS RIGGED! They absolutely do try to keep claims down to make politicians look good. I've been fighting them for 3 months over a disqualification that makes no sense. They're hoping people just give up and find jobs instead of fighting for benefits they earned.

yeah this is confusing stuff... i thought unemployment office was supposed to help people find jobs too? like job training and stuff? so wouldnt they want unemployment to go down?

•You're thinking of workforce development programs. NYS Department of Labor does offer job search assistance and training programs, but that's separate from the benefits division that processes UI claims. Different departments with different goals.
