I had such a hard time reaching anyone at NYS Department of Labor when I needed to speak to someone about my adjudication issues. After weeks of busy signals and dropped calls, I found this service called Claimyr (claimyr.com) that actually got me connected to a real person within minutes. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Might be worth checking out if you need to talk to someone urgently about your appeal.
This is exactly why the unemployment system is broken! Employers lie all the time because there's basically no penalty for false reporting. Meanwhile honest workers like you have to jump through hoops and wait months just to get benefits you're entitled to. The whole system protects businesses over workers.
Also remember about standby status if you're temporarily laid off with a specific return date. That's different from regular UI and has different requirements. And if you're in a union, there might be additional considerations for work sharing programs.
The system is so confusing honestly. I applied last month and they're asking for all this documentation about why I left my job when I thought being laid off was straightforward. Now I'm in adjudication for weeks.
honestly the whole system is messed up, they expect you to take any garbage job just to get off unemployment even if it destroys your career prospects
If you're having trouble getting through to NYS Department of Labor by phone to ask these basic questions, I had good luck with a service called Claimyr that helped me reach an actual agent. They have a demo video at https://youtu.be/qyftW-mnTNI showing how it works. Made it way easier to get my definition questions answered directly rather than trying to decode their website. Check out claimyr.com if you need to talk to someone at NYS Department of Labor.

THE WHOLE SYSTEM IS RIGGED AGAINST WORKERS! They make it so hard to quit a terrible job because they know employers will just abuse people otherwise. I've seen people stay in horrible situations just because they can't afford to lose their UI eligibility. It's not right.
