UPDATE: I finally got through to ESD today! For anyone with a similar issue in the future: They confirmed my payment was returned to them yesterday. The agent was actually really helpful (surprised me after reading horror stories). They're reissuing the payment to a ReliaCard which should arrive in 7-10 business days. They said they can't expedite the card delivery (contrary to what someone suggested above), but once the card arrives, the payment should be on it right away. I also updated the name format to exactly match my bank account just in case I want to switch back to direct deposit later. Thanks everyone for your help and suggestions!
Glad you got through and got it sorted out! That's a relief. Just a heads up though - when you get your ReliaCard, make sure to activate it right away and set up the mobile app. Sometimes there can be a delay between when the card arrives and when your funds actually get loaded onto it, so having the app helps you track when the money hits. Also, keep your direct deposit info updated in case you want to switch back later - the ReliaCard has some fees for ATM withdrawals that can add up if you're not careful about which ATMs you use.
Great advice about the app! I've heard the ReliaCard fees can be brutal if you're not careful. Does anyone know which ATMs are fee-free? I'm worried about getting hit with withdrawal fees on top of everything else I'm dealing with right now.
i had a similar issue last year and ended up going to my local worksource office in person. they couldn't directly fix my esd claim but the lady there gave me a special email address for escalated cases and my issue got fixed in about a week without ever getting through on the phone. might be worth trying if you can get to a worksource office!
That's a great suggestion! There's a WorkSource office about 30 minutes from me. I'll try calling again tomorrow morning with the tips people shared here, but if that fails, I'll try visiting WorkSource in person. Thank you!
Just wanted to add another option that worked for me when I had a similar adjudication mess-up. Contact your state representative's office! I know it sounds crazy, but they have a constituent services department that can help with state agency issues. I called my rep's office and explained I'd been trying to reach ESD for weeks about an incorrect separation reason. They made a call on my behalf and I got a callback from ESD within 3 days. It's free and they're used to helping with these kinds of problems. You can find your rep at leg.wa.gov. Worth a shot if the phone system keeps failing you!
One more thought - make sure you're super clear in the hearing about the "impossible situation" they created. Write it out very clearly: "If my husband followed the PIP by doing X, he would violate his job description which required Y. If he did Y as required in his job description, he would violate the PIP." Having concrete examples of this contradiction will be crucial. Also, did anyone at his workplace ever acknowledge his bipolar condition or the accommodation requests in writing? Any emails or documents that show they were aware of his condition?
Yes! We have emails confirming they received the accommodation requests and doctor's notes. And then emails denying them saying they weren't "necessary for his position" despite his doctor stating otherwise. We also have the written PIP and signed job description that show the contradictions. I think laying it out clearly as you suggested will really help the judge see the impossible situation they created.
I'm a disability advocate and what happened to your husband is unfortunately all too common, but you have a strong case for appeal. The fact that you have written documentation of the accommodation requests being denied AND the contradictory PIP/job description is huge. This shows a clear pattern of setting him up to fail after he disclosed his disability. A few additional things to consider for your appeal: - Request that the judge consider the "interactive process" requirement under the ADA. Employers are legally required to engage in good faith discussions about accommodations, not just flat-out deny them. - Emphasize that the termination happened AFTER he disclosed his bipolar condition and requested accommodations - this timeline matters for showing discriminatory intent. - If possible, get a letter from his treating doctor explaining how the workplace stress and denied accommodations exacerbated his symptoms, making it even more difficult for him to meet the impossible standards they set. The judge will need to determine if a reasonable person could have avoided termination in those circumstances. With contradictory directives and denied medical accommodations, that's clearly impossible. Stay strong - you've got this!
UPDATE: I wanted to let everyone know what worked for me! I ended up trying multiple approaches: 1) Contacted my state rep's office yesterday morning, 2) Used Claimyr to get through to ESD yesterday afternoon, and 3) Re-uploaded my documents with better lighting/resolution. The claims specialist I spoke with using Claimyr was actually able to look at my documents in real-time and said my driver's license photo was too dark for their verification system. I immediately took better photos and uploaded them while on the phone. They flagged my account for review and this morning my identity was verified! My payments are now processing. The state rep's office also reached out and said they'd follow up, but the Claimyr route got me to someone who could actually fix the specific issue. Thanks everyone for your help - I was seriously panicking about rent!

I'm definitely going to try the Claimyr route and also contact my state rep. One thing I wanted to add for others - I found out you can also email ESD directly at [email protected] with your claim number and identity verification concerns. They responded to me in about 3 days (which is faster than getting through on the phone) but unfortunately just gave me the same "it's in queue" response. Still might be worth trying for others who can't get through by phone. The photo quality issue you mentioned makes total sense - I bet that's what's wrong with mine too. I took my photos with my phone in pretty dim lighting. Going to retake everything with better lighting and try Claimyr to get to someone who can actually look at the documents!

And yes, the photo quality thing seems to be a huge issue that nobody tells you about upfront! Just wanted to follow up and say I finally managed to get through this morning after trying the 1:30pm Tuesday suggestion. Waited on hold for 1 hour and 45 minutes, but at least they didn't hang up on me this time. The agent was actually helpful once I got through and explained that my claim needed additional wage verification which is why it was stuck. They're sending me a form to fill out, so hopefully it gets resolved soon.

I'm dealing with this exact same nightmare right now! Been trying to call for over 2 weeks about my pending claim and getting nowhere. Reading through all these suggestions gives me some hope though. I'm definitely going to try the Tuesday 1:30pm time slot that Lucas mentioned, and I'm also going to contact my state rep's office tomorrow morning. It's ridiculous that we have to jump through so many hoops just to get basic help with our claims, but at least now I have some actual strategies to try instead of just randomly calling and getting hung up on.
