Has anyone actually had their Schedule E audited for trying to claim unreimbursed partnership expenses despite the TCJA suspension? I've been claiming my home office on Schedule E anyway because my tax software lets me and I haven't had an issue for 2 years...

That's playing with fire! The software lets you input it, but that doesn't mean it's legal. Just because you haven't been audited yet doesn't mean you won't be. The IRS has up to 3 years to audit your return (6 years in some cases).

Good point - definitely don't want to risk an audit. I think I'll look into the guaranteed payment approach mentioned above. Seems like a more legitimate way to get the deduction while staying compliant.

Here's what I learned: The key issue is that under TCJA, unreimbursed partnership expenses are essentially not deductible on your personal return through 2025. However, there are several legitimate workarounds: 1. **Partnership Reimbursement Plan**: Have your partnership adopt an accountable plan to reimburse you for the home office expenses. The partnership deducts it, and you don't report the reimbursement as income. 2. **Guaranteed Payments**: As mentioned above, the partnership can make guaranteed payments to you for office space usage, which creates self-employment income that you can then deduct against on Schedule C. 3. **Partnership-Level Allocation**: Some partnerships can allocate these expenses at the entity level rather than having partners claim them individually. The guaranteed payment route worked best for me since it was straightforward to document and my partnership was small enough to easily amend our agreement. Yes, you pay SE tax on the guaranteed payments, but the home office deduction (using the simplified method) often more than offsets this. Whatever you do, don't just claim it on Schedule E without proper structure - the IRS computers will eventually catch up with returns claiming suspended deductions. Better to do it right from the start!

I want to make sure the math works out before I propose this to my partners. Ugh, I feel your pain! Just went through this exact same thing last month. Got my adjustment letter and was told 180 days too, but it actually only took about 7 weeks from when I got the letter. The 180 days seems to be their worst-case scenario they give everyone. Have you been able to check your transcripts online? That usually gives you a better idea of what's actually happening with your return. The waiting is definitely the most stressful part though - hang in there! šŸ¤ž

Your partner should definitely document everything right now - work schedules, payment records, any written instructions about dress code or procedures, texts about when to come in or take breaks. The more evidence she has showing that her boss controls how, when, and where she works, the stronger her case will be. One thing to consider is that many states have their own independent contractor tests that are even stricter than the federal IRS test. Some states use an "ABC test" where all three criteria must be met for someone to be considered an independent contractor. Given that your partner works set hours following someone else's rules, she'd likely fail most state tests too. The salon owner may genuinely not understand the law, but ignorance isn't a defense. Employee misclassification costs the government billions in lost tax revenue and denies workers basic protections. Your partner deserves to have proper employment status, access to unemployment benefits, and not have to pay double FICA taxes on income that should be treated as wages.

Has anyone checked if this varies by state? I'm in Tennessee and had a similar issue with a furniture purchase that never arrived. In my case, the retailer insisted they couldn't refund the sales tax because they'd already sent it to the state, but when I called the Tennessee Department of Revenue directly, they told me the retailer was responsible for refunding the full amount including tax since the sale wasn't completed.

In California, retailers are definitely required to refund sales tax on returned items or canceled sales. I worked in retail management for years, and we always refunded the full amount including tax when items were returned or when orders couldn't be fulfilled.

Colorado Tax Portal Shows ($9,920.00) Negative Balance After Status Changed from 'Refund Reviewed' to 'Processing' - Is This My Refund or Do I Owe?

Filed my Colorado state tax return in February 2025 and got a confirmation that it was received. The status initially showed 'refund reviewed' but then switched back to 'refund processing' which seemed weird. Now when I check the portal, there's a really confusing balance showing up. I just logged into the Colorado tax portal at 6:41 and under "Individual Income Tax" for my "2024 Return" it shows: Status: Received Account Balance: ($9,920.00) I can see options to "View or Amend Return," "View 1099-G Amounts," "Check Refund Status," "Make a Payment," "File/Amend and View Returns/Payments," and "Additional Actions" in the portal. Does this negative balance of ($9,920.00) mean I owe money to the state or is this actually indicating my refund amount? I'm totally confused because usually a negative number would mean I owe, but this appeared suddenly after the status change. I'm wondering if this balance display is how Colorado shows pending refunds, or if somehow I messed up my return and actually owe the state thousands instead of getting the refund I was expecting. The return was accepted without issues originally, so this sudden balance is really throwing me off. Has anyone else dealt with something similar with Colorado state refunds? I've checked the colorado.gov Revenue and Taxation websites but couldn't find a clear explanation for what a negative balance actually means in this context.

I'm literally looking at the EXACT same screen on the Colorado website right now. Called them this morning (used Claimyr.com to get through) and was told the negative balance is definitely my refund. The lady said they're just backed up processing payments but should go out within 10 business days. The system is super confusing!

That negative balance in parentheses is definitely your refund amount - it's just how their accounting system displays money they owe you. I know it's super counterintuitive because normally we think of negative numbers as owing money, but in government accounting, a negative balance means they have a liability to pay you. The status bouncing between "refund reviewed" and "refund processing" is totally normal too - it just means your return passed their review stage and is now in the payment queue. You should see that money deposited within the next week or two.
