Just a quick update on the "reasonable assurance" rule - as of January 2025, EDD updated their guidelines for contract employees at educational institutions. The key factors they now consider are: 1. Whether there's a written guarantee of reemployment 2. Whether there's a consistent history of reemployment after breaks 3. Whether the contractor (not just the school) has indicated future work Make sure to download and review Form DE 1870C from the EDD website before your interview - it contains the specific questions they'll ask about educational employment. Being prepared with this information will help tremendously during your interview.
i think they just do these interviews to scare people tbh. my cousin works at a school cafeteria (not district employee either) and they did this same thing to her every summer for like 3 years. she always got approved in the end but they make you jump thru hoops first cause thats what edd does lol
Thanks everyone for the advice! I just submitted my unemployment application and listed both employers. I tried to be very detailed in explaining the situation. Now I'm just waiting to see what happens. I also called the Labor Commissioner's Office about filing a wage claim for the unpaid work, and they're sending me the paperwork. Fingers crossed this all works out soon because my savings are getting really low.
Good job taking action quickly! Be prepared for EDD to schedule an eligibility interview - this is standard procedure when there's a voluntary quit involved. Make sure your phone number is up to date in the system and answer any unknown calls during business hours as it could be EDD. Also check your UI Online account daily for any notices or requests for additional information.
EDD is THE WORST at sending mail!!! I never got ANYTHING from them on time during my whole claim. Everything was always late or never came at all. I ended up just doing everything online because I couldn't trust their mail system. Did you try logging into UI Online??? That's where I got all my tax forms.
Just a heads-up for anyone dealing with this issue in the future: EDD makes 1099-G forms for unemployment benefits available by January 31st each year. You can access them immediately in your UI Online account rather than waiting for mail. If you need forms from previous years (like 2020-2023), they remain accessible in your account history. If you've changed addresses or no longer have UI Online access, you can request a duplicate 1099-G by calling 1-866-401-2849, but online access is much faster if you can get into your account. This applies to regular UI, disability, and PFL benefits.

One additional thing to be aware of: make sure this ineligibility determination is only for the weeks you had excessive earnings and doesn't extend to other weeks. Sometimes the EDD can make mistakes in the date ranges. If you believe the determination incorrectly includes weeks where you should have been eligible, you would need to appeal within 30 days of receiving the notice.

•Good point! I checked and the ineligibility determination is only for the exact weeks I did the consulting work (Feb 15-Mar 8). All my other weeks are showing as paid correctly. So it looks like everything is accurate.

dont forget u still gotta report ANY income even if its just 1 hour of work... see ppl get in trouble all the time cuz they think small amounts dont matter
